These Terms of Service ("Terms") govern your access to and use of the United States version of the Tingit online store (the "Shop") and your purchase of physical goods from the Shop. The Shop is operated by UAB "Rebel Origin," trading as Tingit ("Tingit," "we," "us," or "our").
By accessing the Shop, creating an account, or placing an order, you agree to these Terms and to the policies incorporated by reference, including our U.S. Return & Refund Policy and Privacy Policy. If you do not agree, do not use the Shop or place an order.
These Terms are intended for U.S. customers. Mandatory federal, state, and local consumer rights that cannot lawfully be waived or limited remain unaffected.
1. ELIGIBILITY AND SCOPE
You must be at least 18 years old, or the age of legal majority in your state if higher, and legally capable of entering into a binding contract to place an order. If you place an order on behalf of a company or other entity, you represent that you have authority to bind that entity.
Products sold through the Shop are intended for personal, household, or other lawful use unless we expressly agree otherwise. You may not use the Shop for unlawful purposes, fraudulent transactions, unauthorized resale, or other activity that violates these Terms.
2. ACCOUNTS
If account functionality is available, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account to the extent permitted by law. You must provide accurate, current information and promptly notify us at support@tingit.com if you believe your account has been compromised.
We may suspend or restrict an account where reasonably necessary to protect the Shop, customers, or Tingit from fraud, security threats, policy abuse, or unlawful activity. This does not limit any non-waivable consumer right.
3. ORDERS AND ORDER ACCEPTANCE
Your submission of an order is an offer to purchase the products shown in your order. An order confirmation, order number, or payment authorization does not necessarily mean that we have accepted the order. We may verify payment, delivery, fraud-prevention, inventory, or other information before acceptance.
We may refuse, limit, or cancel an order before shipment where reasonably necessary because of stock unavailability, suspected fraud or unauthorized payment, pricing or listing errors, shipping restrictions, quantity limits, sanctions or legal restrictions, or other legitimate reasons. If we cancel an order after payment has been captured, we will refund the amount we are legally required to refund.
We may limit quantities purchased per person, household, account, payment method, or order, including where we reasonably believe an order is intended for unauthorized resale or circumvention of promotion limits.
4. PRICES, PAYMENT, TAXES, AND ERRORS
Prices for the U.S. Shop are generally displayed in U.S. dollars (USD). Applicable shipping charges, taxes, duties, or other charges will be shown or described at checkout to the extent available and required by law.
Payment is processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges for your order.
We try to ensure that prices, promotions, descriptions, and other Shop information are accurate. If a material pricing, calculation, or listing error is discovered before shipment, we may correct the error and either contact you for approval of the corrected order or cancel the affected item or order and issue any legally required refund. Nothing in this section permits us to engage in deceptive pricing practices or removes rights provided by applicable law.
5. PRODUCT INFORMATION, AVAILABILITY, AND VARIATION
Product images, colors, packaging, measurements, fragrance descriptions, performance examples, and other content are provided for general informational purposes. Actual appearance may vary because of screen settings, packaging updates, manufacturing tolerances, batch variation, material condition, or other factors that do not necessarily make a product defective or misdescribed.
Product availability is not guaranteed until an order is accepted and fulfilled. We may discontinue products, change packaging, or make non-material updates to product presentation without prior notice, provided that the product supplied remains consistent with applicable law and the material description presented at purchase.
Third-party branded products sold through the Shop may also be subject to manufacturer instructions, warnings, and warranties. Tingit does not adopt or expand a third-party manufacturer warranty unless we expressly state otherwise, and nothing in these Terms limits obligations we have as the seller under applicable law.
6. PRODUCT USE, CARE, AND RESULTS
Cleaning, stain-removal, odor-care, leather-care, and fabric-care results can vary based on the material, finish, dye, age, prior treatment, stain type, contamination, method of use, and other conditions outside Tingit's control. A result shown in product content, demonstrations, reviews, or marketing does not guarantee an identical result for every item or surface.
You are responsible for reading and following the product label, directions, warnings, garment or item care instructions, and any material-compatibility guidance before use. Where appropriate, test the product on a small, inconspicuous area before broader application. Do not use a product on a material or for a purpose for which it is not represented as suitable.
To the fullest extent permitted by law, Tingit is not responsible for damage caused solely by misuse, use contrary to instructions or warnings, failure to test where reasonably appropriate, improper storage, unauthorized modification, use on an unsuitable material or surface, or another external cause arising after delivery. This section does not limit non-waivable product-safety, product-liability, warranty, or consumer-protection rights.
7. SHIPPING, DELIVERY, AND CUSTOMS
Available delivery methods, estimated delivery times, and shipping charges are shown through the Shop or applicable Shipping Policy. Delivery and transit estimates are not guarantees unless expressly stated as guaranteed.
We will comply with applicable U.S. requirements governing promised shipment times. If we cannot ship within a promised time, or within the legally applicable period where no shipment time was stated, we will provide the delay notice, cancellation option, or refund required by applicable law.
You are responsible for providing a complete and accurate delivery address. Costs caused by an incorrect or incomplete address, refusal of delivery, or failure to collect a parcel may be charged or deducted only to the extent permitted by law and disclosed in the applicable policy.
Unless otherwise stated at checkout, government duties, import taxes, customs charges, brokerage fees, or similar charges assessed directly by a government authority, carrier, or other third party may be the customer's responsibility. Amounts paid directly to such third parties are not collected by Tingit and are not refundable by Tingit except to the extent applicable law requires otherwise.
After confirmed delivery to the delivery address provided for the order, the risk of theft or loss generally passes to the customer to the extent permitted by law. If an order is not delivered, is materially damaged in transit, or another delivery issue triggers a mandatory remedy, we will provide the remedy required by applicable law.
8. RETURNS, REFUNDS, AND EXCHANGES
Returns and refunds for U.S. purchases are governed by the Tingit Return & Refund Policy (United States) in effect for the order. Tingit currently offers eligible products a voluntary 14-calendar-day change-of-mind return subject to the conditions in that policy. This voluntary policy is separate from rights relating to defective, damaged, incorrect, unsafe, or misdescribed products.
We do not offer direct exchanges unless expressly stated otherwise. Where a return is eligible, you may return the original product under the applicable policy and place a new order.
9. PROMOTIONS, BUNDLES, DISCOUNTS, AND GIFTS
Promotions may be subject to additional terms displayed with the offer. Unless the promotion states otherwise, promotional codes and discounts may not be combined, have no cash value, and may be limited by customer, order, product, geographic area, quantity, or time period.
If a discount, bundle price, quantity discount, free product, or gift depends on purchasing or keeping a specified quantity or value of products, a cancellation or partial return may affect the promotional benefit. Any refund adjustment will be made only as described in the applicable promotion terms and Return & Refund Policy and only to the extent permitted by law.
We may cancel or correct a promotion where there is an obvious technical error, unauthorized publication, fraud, abuse, or manipulation, provided that we comply with applicable law and do not retroactively deprive a customer of a legally enforceable completed benefit.
10. REVIEWS, USER CONTENT, AND FEEDBACK
The Shop may allow you to submit reviews, photographs, comments, feedback, or other content ("User Content"). You retain ownership of your User Content. By submitting it, you grant Tingit a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, display, format, translate, adapt, distribute, and use the User Content for operating, improving, and promoting Tingit and its products, subject to applicable privacy, publicity, and consumer-protection law.
You represent that you have the rights needed to submit the User Content and that it does not infringe intellectual-property, privacy, publicity, or other rights; contain unlawful, threatening, defamatory, deceptive, or malicious material; or include malware or confidential information you are not authorized to disclose.
Reviews must reflect genuine experiences and honest opinions. Any incentive, free product, discount, employment, family relationship, or other material connection that could affect how a review or endorsement is evaluated must be disclosed where required by law. Tingit may moderate content for legal, security, relevance, or policy reasons, but nothing in these Terms prohibits a consumer from publishing an honest review or otherwise exercising rights protected by applicable law.
11. ACCEPTABLE USE
You may not misuse the Shop or attempt to interfere with its security or operation. Prohibited conduct includes unauthorized access, scraping or automated extraction except as permitted by law or written authorization, introduction of malware, impersonation, fraudulent transactions, misuse of promotions, infringement of third-party rights, or use of the Shop to violate applicable law.
We may take proportionate technical or account-level measures to prevent or respond to prohibited conduct, fraud, or security threats.
12. INTELLECTUAL PROPERTY
The Shop, including its trademarks, logos, text, photographs, graphics, product presentation, software, and other content, is owned by or licensed to Tingit and is protected by applicable intellectual-property laws. Except for the limited right to access and use the Shop for lawful personal or internal business purposes, no rights are granted to you by implication, estoppel, or otherwise.
You may not reproduce, republish, distribute, sell, exploit, modify, or create derivative works from Shop content for commercial purposes without prior written permission, except where applicable law expressly permits such use.
13. THIRD-PARTY SERVICES AND LINKS
The Shop relies on third-party providers for functions such as ecommerce hosting, payment processing, fraud prevention, shipping, reviews, analytics, advertising, and customer support, and may contain links to third-party sites or services. Third-party services may have their own terms and privacy practices. Tingit is not responsible for third-party services outside our control except to the extent applicable law provides otherwise.
14. PRIVACY
Our collection and use of personal information are described in the Tingit Privacy Policy (United States). The Shop is powered by Shopify, which also processes certain consumer personal data in connection with Shopify-powered stores and services. Shopify's practices are described in its own consumer privacy policy.
15. DISCLAIMERS OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SHOP AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT FOR EXPRESS WARRANTIES WE MAY PROVIDE IN WRITING AND WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED, TINGIT DISCLAIMS IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIMITATIONS. IN THOSE STATES, THE ABOVE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS DISCLAIMS A WARRANTY, PRODUCT-LIABILITY RIGHT, SAFETY RIGHT, OR OTHER PROTECTION THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.
16. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, TINGIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SHOP, AN ORDER, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, TINGIT'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT ORDER WILL NOT EXCEED THE AMOUNT YOU PAID TINGIT FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING WHERE APPLICABLE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY, PRODUCT LIABILITY, OR VIOLATIONS OF NON-WAIVABLE CONSUMER RIGHTS.
17. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Tingit harmless from third-party claims, losses, or reasonable costs arising directly from your unlawful misuse of the Shop, your material breach of these Terms, or User Content you submit that infringes a third party's rights. This section does not require a consumer to indemnify Tingit for Tingit's own negligence, unlawful conduct, or breach of a non-waivable duty.
18. FORCE MAJEURE
To the extent permitted by law, Tingit is not responsible for a delay or failure caused by events beyond our reasonable control, such as severe weather, natural disasters, war, civil disturbance, government action, labor disruption, carrier interruption, customs disruption, cyberattack, utility or internet failure, epidemic, or supply-chain interruption. This does not remove any cancellation, refund, or other right that applicable law requires in the circumstances.
19. GOVERNING LAW AND DISPUTES
Because Tingit is operated by UAB "Rebel Origin," these Terms and contractual matters not governed by mandatory U.S. law are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles. Where federal, state, or local U.S. law gives a consumer non-waivable rights or remedies, those rights and remedies remain available.
Before filing a formal claim, you and Tingit are encouraged to contact the other party and make a reasonable good-faith effort to resolve the issue informally. Any dispute that cannot be resolved informally may be brought in a court with lawful jurisdiction. To the extent a forum-selection clause is enforceable, the courts of Vilnius, Lithuania will have jurisdiction over contractual disputes not subject to a mandatory consumer venue rule. Nothing in this section requires you to waive a forum or procedure that applicable law gives you on a non-waivable basis.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version made available when an order is placed will govern that order unless a change is required by law. Updated Terms apply prospectively to later use of the Shop and later orders. If applicable law requires notice or consent for a material change, we will provide it.
21. GENERAL
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent, except where applicable law permits otherwise. Tingit may assign these Terms in connection with a merger, reorganization, sale of assets, or similar transaction, subject to applicable law.
These Terms and the policies expressly incorporated by reference form the agreement between you and Tingit regarding the U.S. Shop and supersede prior statements on the same subject, except for product-specific terms, promotion terms, or other written terms that expressly apply to a transaction.
